Caliper files patent infringement suit against Carestream
Caliper Life Sciences, its wholly owned subsidiary Xenogen, and Stanford University have filed a patent infringement lawsuit against Rochester, N.Y.-based Carestream Health.

The lawsuit, which has been filed in the U.S. District Court for the Eastern District of Texas, alleges that Carestream willfully infringed on seven U.S. patents that Caliper, through Xenogen, exclusively licenses from Stanford University in Palo Alto, Calif., said the Hopkinton, Mass.-based Caliper.

In addition to a willful infringement finding, Caliper is seeking compensatory damages, a trebling due to willfulness, a permanent injunction and attorneys' fees against Carestream.

The patents in question, which are part of Caliper’s Optical Imaging Patent Suite, include methods for non-invasive in vivo imaging of fluorescence and bioluminescence in animals.
