Abbott Labs dismissed from Johnson & Johnson suit against Boston Scientific
U.S. District Judge Gerard Lynch in Manhattan dismissed a request by Boston Scientific, the parent company of medical device provider Guidant, which sought a dismissal of the Johnson & Johnson lawsuit against Guidant for breach of contract on Aug. 29.

Lynch did accept Abbott Laboratories’ motion to be dismissed from the lawsuit.   

In September 2006, Johnson & Johnson filed a suit seeking at least $5.5 billion in damages from Boston Scientific and Abbott Laboratories, to compensate for its failed bid for Guidant. In the initial charges, Johnson & Johnson alleges that Abbott received confidential information from Guidant, which allowed Boston Scientific to acquire Guidant for $27 billion.

Guidant has paid Johnson & Johnson a termination fee of $705 million because they had initially agreed to the acquisition.
