A radiology provider that accused Cigna of wrongfully denying payment for COVID-19 services is urging a New Jersey federal judge not to grant the insurer’s request to dismiss the lawsuit, according to Law360.
Open MRI and Imaging last week said it was within its rights to take legal action against the nation’s four largest commercial insurer. The lab said Cigna’s motion to dismiss its amended claim didn’t accurately characterize the accusations and misrepresented federal regulations outlined in COVID-19 relief bills, Law360 reported on April 7.
The Rochelle Park, New Jersey, imaging lab first filed suit on Aug. 12, claiming the insurance giant improperly refused payment for nearly $400,000 in diagnostic services and treatment related to the coronavirus.
Then on Feb. 24, Cigna Health and Life Insurance Company called on the court to toss the provider’s lawsuit, arguing it hadn’t identified the patients behind the denied payments nor provided key information needed to back up claims its decision violated New Jersey’s Employee Retirement Income Security Act.
